I have multiple domains on same server and this is the only one with that problem. I have done same upgrades on multiple other sites on same server. This was first time ever seeing said error? Sometimes it's less hassle to just go a different route than to fix something your going to change anyway. LOL
I finally just copied all the content, deleted older version and did a clean install for upgrade and no issues.
